PLEASE READ THIS STARBUCKS REWARDS PROGRAM TERMS OF USE (“TERMS OF USE” CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE STARBUCKS REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS OF USE, DO NOT ACCESS OR PARTICIPATE IN THE STARBUCKS REWARDS PROGRAM.

  1. General

1.1        These Terms of Use apply to your access to, and use of, all or part of any website or mobile application, and participation in, the Starbucks Rewards Program which is operated by Coffee Concepts (Cambodia) Limited (“Starbucks”, “we” or “our”), an authorized licensee of Starbucks Coffee International, Inc in Cambodia. These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with Starbucks for other products and services. 

1.2        You agree that we may provide updates, notices, disclosures and amendments to these Terms of Use, and other information relating to the Starbucks Rewards Program by electronic means, including posting such information and materials online at https://www.starbucks.com.kh (“Starbucks Website”).

  1. Changes to Terms

Starbucks reserves the right to change, modify and/or terminate the Starbucks Rewards Program and/or these Terms of Use or any policies, FAQs, or guidelines pertaining to Starbucks Rewards Program, in whole or in part, at any time and in its sole discretion. Any changes or modifications will be effective immediately and may be posted on the Starbucks Website, and you waive any right, as you may have, to receive specific notice of such changes or modifications. Your continued access to or participation in Starbucks Rewards Program following any such changes or modifications confirms your acceptance of these Terms of Use and any such changes or modifications; therefore, you should review these Terms of Use and applicable policies and FAQs frequently to understand the terms and conditions that apply to Starbucks Rewards Program. If you do not agree to these Terms of Use, you must stop accessing and participating in Starbucks Rewards Program.

  1. Personal Use

3.1        The Starbucks Rewards Program is intended for personal use only. Commercial use is prohibited. Starbucks Rewards Program is not targeted towards, nor intended for use by, anyone under the age of eighteen (18). If you are thirteen (13) years or older but under the age of eighteen (18), you should review these Terms of Use with your parent or guardian to make sure you and your parent or guardian understand and agree to these Terms of Use. Should your parent or guardian not agree to these Terms of Use, you must stop participating in Starbucks Rewards Program.

3.2        Our Privacy Policy is incorporated into these Terms of Use and also governs your participation in Starbucks Rewards Program. Please read the Privacy Policy carefully to understand how Starbucks collects, uses and discloses information about its customers, how to update or change your personal information, and how we communicate with you. By participating in Starbucks Rewards Program, you agree, consent and approve to all actions that we take in relation to your data consistent with our Privacy Policy.

3.3        Starbucks shall not be liable or responsible for any of your content uploaded or stored by you or third party, or for any loss or damage thereto, nor is Starbucks liable for any user conduct or any mistakes; you are solely responsible for your participation in the Starbucks Rewards Program. 

3.4        In the event that you use a public computer or multiple people have access to such computer to log in into your registered Starbucks Rewards account, you shall make sure to follow all relevant instructions to ensure you are sufficiently disconnected and logged off from your account and the computer system you are using to prevent unauthorized control over your account, as well as your Starbucks Card.

  1. About Starbucks Rewards Program

Starbucks Rewards Program is one way in which Starbucks endeavors to reward and thank loyal customers for patronizing our business and purchasing Starbucks products. Members of Starbucks Rewards Program are able to earn and accumulate “Stars” that can be redeemed for Starbucks Rewards Program’s benefits, also known as “Rewards”, at participating Starbucks stores in Cambodia.

  1. Starbucks Card

The Starbucks Card refers to a physical and reusable Starbucks branded plastic card that customers can load or reload money onto and use to make purchases at participating Starbucks stores in Cambodia. The Starbucks Card is valid only in all participating Starbucks stores in Cambodia and must be activated at the minimum value of United States Dollars Five (USD5.00) per card for the first use. If you want to purchase Starbucks Cards as gift cards, they just need to be activated. Once you activate a Starbucks Card, it can be used to make purchases. However, the Starbucks Card is non-refundable as well as not exchangeable for cash or credit balance. Normally, you can check your Starbucks Card balance by asking the barista at any participating Starbucks stores in Cambodia, or the Starbucks Website or through the Starbucks Cambodia Mobile Application (“Mobile App”) if you have registered to join the Starbucks Rewards Program. When the amount in your Starbucks Card is low, the Starbucks Card can be reloaded. In Cambodia, you can reload value onto your Starbucks Card in denominations of United States Dollar (USD/$) for any amount between United States Dollars Two and Fifty Cents (USD2.50) and United States Dollars Five Hundred (USD500.00), provided that United States Dollars Five Hundred (US500.00) is the maximum amount a card can hold at any time. You are required to activate/reload the Starbucks Card by cash or credit card, but you cannot use the Starbucks Card to activate/reload another Starbucks Card.

A Starbucks Card will expire three (3) years after the last financial transaction. The term “financial transaction” shall mean one of the following actions:  

  • Activation;
  • Reload;
  • Redemption of rewards for a registered Starbucks Card;
  • Purchasing transaction; and
  • Fund Transfer (hereinafter defined) between the registered Starbucks Cards.

Upon the expiration of any Starbucks Card or if there is any change in law, practices, procedures and structure which may render the Starbucks Card invalid or ineffective, the remaining balance in such expired Starbucks Card shall be cancelled immediately without further notice to you.  The balance in such Starbucks Card shall become the revenue of Starbucks and Starbucks shall not have any responsibility or obligation to the holder of such Starbucks Card. For the avoidance of doubt, notwithstanding anything to the contrary in these Terms of Use, any such remaining balance shall be non-refundable.

  1. Joining Starbucks Rewards Program

You can enroll in Starbucks Rewards Program and begin accumulating Stars by visiting the Starbucks Website or installing the Mobile App and following prompts to create a Starbucks Rewards account and register at least one (1) activated physical Starbucks Card to such account. Upon signing up an account, you will receive a verification email to your email address that is used for signing up and activating your account. Please contact our Starbucks Rewards Customer Care Center at 023 986 591 if you do not receive the verification email within 24 hours.

The registration process may require that you provide the following information: password, email address (required in order to receive all eligible Rewards), physical address, mobile number, the activated Starbucks Card number, and card security code (CSC), birthday, name and marketing preferences.

The Starbucks Card can be registered to your account at any given time, but only one (1) account is personal to you. You can register / add a maximum of twenty (20) activated Starbucks Cards in such account. The balance in a registered Starbucks Card (a transferred Starbucks Card) can be fully transferred to another registered Starbucks Card within that same account (Fund Transfer), but a partial transfer is not permitted. The transferred Starbucks Card becomes empty yet remains active for further reloading and use. The transfer of balance in each Starbucks Card can be only performed personally by you via our website or through the Mobile App.

  1. Earning Stars

Only transactions paid using registered Starbucks Card can earn Stars which shall be added into your Starbucks Rewards account.

The benefits that are available to you through Starbucks Rewards Program are based on the number of “Stars” that you earn. You can earn Stars by making purchases through the Mobile Order and Pay functions of the Mobile App or at any participating Starbucks stores in Cambodia by presenting your relevant registered Starbucks Card or barcode in the Mobile App to the barista upon payment.

Please note that spending will only be calculated and Stars accumulated after the activated Starbucks Card is registered to your Starbucks Rewards account; and you must present your relevant registered Starbucks Card or barcode in the Mobile App for scanning at the time of payment.

No “Star” will be rewarded for any purchases with a registered Starbucks Card in any Starbucks stores outside of Cambodia or for any purchases of Starbucks gift card.

You will earn Stars based on the value of your purchase at the rate of one (1) Star for each United States Dollars fifty cent (USD0.50) spent using any of your registered Starbucks Card. At Starbucks’ sole discretion, Stars may be earned and awarded in fractional amounts depending on the value of your purchase paid fully by using registered Starbucks Card(s) only.

Typically, Stars for qualifying purchases from participating Starbucks stores are automatically added to your account at the earliest after the transaction is completed or within approximately forty-eight (48) hours. From time to time, we, or others acting with our permission, may offer you special promotions that offer you “Promotional Stars.” Promotional Stars, such as “bonus” Stars, will be awarded as described in the applicable promotional offer and will be subject to any additional terms set forth in the promotional offer.

  1. Starbucks Rewards Program Benefit Levels

Currently, there are two (2) levels of benefits within Starbucks Rewards Program that are determined by the number of Stars that you accumulate in your account for each consecutive twelve (12)-months period. By opening an account and registering an activated Starbucks Card, you will be automatically enrolled in the Starbucks Rewards Program at the Green Level. If you earn two hundred (200) new Stars within the twelve (12)-months period following your enrollment date, you will qualify for the Gold Level.

Once you reach a specific level within Starbucks Rewards Program, you will receive the specific benefits that are applicable to that level at that time.

To maintain all benefits of the Green Level, you only need to register at least one (1) of your activated Starbucks Card to your account.

To maintain all benefits of the Gold Level, you must earn at least two hundred (200) new Stars during each consecutive twelve (12) months period following the date that you reached the Gold Level. On the anniversary date of the Gold level, your Star count will be reset. For your information, the reset at Gold Level means the Stars will automatically be converted into a number of free drink(s) (rounded down) and will only indicate the balance remaining Stars after such conversion. For example, if you have one hundred and fifty (150) Stars, the reset at Gold Level means you will be entitled to one (1) free drink and you will have a balance of fifty (50) Stars.

Please note that Stars accumulated for each level of the Starbucks Rewards Program will only be valid for twelve (12) months from the date when you reach the particular level. However, any Rewards you have accumulated but which have not been used and have not expired will remain available in your account and you can redeem such Rewards in accordance with the prescribed conditions herein.

You can view or track your Star balance and available Rewards on the Starbucks Website or through the Mobile App. Starbucks reserves the right to change a number of benefit levels and to change the benefits and Rewards associated with each level in its sole discretion at any time.

8.1        Green Level

By registering only one (1) of your activated Starbucks Card, you are automatically enrolled into the “Green Level” of the Starbucks Rewards Program. If you did not earn two hundred (200) Stars within a twelve (12)-months period to upgrade to the Gold Level, you will remain at the “Green Level” and your Star balance will be reset to zero (0). Rewards at the Green Level may include:

  • Birthday Reward. You will receive one (1) tall size beverage in the month of your birthday as described below:

The birthday Reward will be automatically added to your account on the first day of your birthday month. The offer for birthday Reward expires the day after your birthday month. You must present your registered Starbucks Card or relevant barcode in the Mobile App to the barista at a participating Starbucks store in order to redeem your Reward. You will receive only one (1) birthday Reward regardless of the number of registered Starbucks Cards you may have. The birthday Reward may be redeemed at any participating Starbucks stores in Cambodia only and is not applicable to ready-to-drink bottled beverages.

  • Double stars earned on the first purchase within thirty (30) days after registration.
  • Earn five (5) bonus stars for every cup of a promotional beverage during the first week of launch.

8.2        Gold Level

Upon earning two hundred (200) Stars in a twelve (12)-months period, you will be placed at the “Gold Level” and your Star balance will be reset. For your information, the reset at Gold Level means the Stars will automatically be converted into a number of free drink(s) (rounded down) and will only indicate the balance remaining Stars after such conversion. During each twelve (12)-months period when you reach and/or maintain the Gold Level, the benefits of the Gold Level may include:

  • Green Level Rewards. You will still be able to redeem any Green Level Rewards which have not been redeemed and have not expired before you reached the Gold Level. However, you must redeem such unused Rewards within their prescribed validity period.
  • Birthday Reward. You will receive one (1) tall size beverage in the month of your birthday as described below:

The birthday Reward will be automatically added to your account on the first day of your birthday month. The offer for birthday Reward expires the day after your birthday month. You must present your registered Starbucks Card or relevant barcode in the Mobile App to the barista at a participating Starbucks store in order to redeem your Reward. You will receive only one (1) birthday Reward regardless of the number of registered Starbucks Cards you may have. The birthday Reward may be redeemed at any participating Starbucks stores in Cambodia only and is not applicable to ready-to-drink bottled beverages.

  • Free Drink Reward. You will receive one (1) free tall size handcrafted drink of your choice for every one hundred (100) additional Stars that you earn above the two hundred (200) Stars needed to reach the Gold Level, as described below:

Your Free Drink Reward will be automatically loaded onto your account within approximately forty-eight (48) hours upon you earning every one hundred (100) additional Stars. The Free Drink Reward expires after one (1) month from the date that the Free Drink Reward is loaded onto your account. You must present your relevant registered Starbucks Card or barcode in the Mobile App to the barista at a participating Starbucks store in order to redeem your Reward and receive your Free Drink item. You will receive only one (1) Free Drink Reward for everyone hundred (100) additional Stars that you accumulate. The Free Drink Reward may be redeemed at any participating Starbucks stores in Cambodia only and is not applicable to ready-to-drink bottled beverages.

  • Earn five (5) bonus stars for every cup of promotional beverage during the first week of launch.
  • Earn seven (7) bonus stars for every serve-ware purchase.
  • Special offers and/or invitations. You may, at the sole discretion of Starbucks, receive additional special offer(s) and/or invitation(s) to participate in any event(s) held by or for Starbucks by email or physical mail. You must opt-in to receive promotional and marketing offers from Starbucks and may be required to provide a valid email, mobile number and physical address in order to receive your special offers and invitations. Special offers and invitations may be customized based on your purchasing behaviors and preferences. Special offers may include periodic discounts on foods, drinks and merchandise. Special offers may have certain restrictions including expiration dates and short time-limited redemption periods. Special offers are personal to you and cannot be shared, copied or transferred. You may be required to present your relevant registered Starbucks Card or barcode in the Mobile App in order to redeem special offers. Please read each offer carefully for specific details, expiration dates, limitations and restrictions when such offer is loaded onto your account.

You are responsible for updating your Starbucks Rewards account and ensuring all information you provide in your account is accurate and up to date at all times, including your email and mailing addresses at https://card.starbucks.com.kh. If any information you provide is not accurate or up to date, you may not receive special offer(s) and/or invitation(s). You can view and track your available offer(s) and/or invitation(s) on the Starbucks Website or on the Mobile App. 

  1. Miscellaneous

9.1        There is no membership fee associated with Starbucks Rewards Program, but an activated Starbucks Card with minimum value of United States Dollars Five (USD5.00) is required to register a Starbucks Rewards account. Stars accumulated under the Starbucks Rewards Program have no cash value.

 

9.2        Starbucks may introduce promotion programs relating to Starbucks Rewards Program whereby these Terms of Use may be varied as applicable to such programs.

9.3        If your Starbucks Card is lost, stolen, or destroyed, you may lose the Starbucks Card balance, except for the Star balance, unless your Starbucks Card is a registered Starbucks Card. If you are a member of the Starbucks Rewards Program, you may protect the Star balance on your Starbucks Rewards account and the balance of such Starbucks Card if lost, stolen or destroyed by notifying us at https://card.starbucks.com.kh or through the Mobile App or calling our Starbucks Rewards Customer Care Center at 023 986 591, and confirming your instruction. If you have only one registered Starbucks Card, a request for a replacement card can be sent to us, and accordingly, all balance of the lost/stolen/destroyed Starbucks Card can be transferred to the alternative card. You can continue to redeem the unused Rewards within their prescribed validity period by using such alternative card, otherwise, the balance of the lost/stolen/destroyed Starbucks Card can be transferred to another registered Starbucks Card of yours.

9.4        Your Stars, Rewards, registered Starbucks Card(s), and your account under Starbucks Rewards Program are personal to you and may not be sold, transferred or assigned to, or shared with family, friends or others, or used by you for any commercial purpose. You may have only one (1) Starbucks Rewards account that is personal to you.

9.5        Without notice and by its sole discretion, Starbucks reserves the right to “deregister” your Starbucks Rewards account of which all registered Starbucks Cards have been expired or deactivated as the case may be. In the event that your Starbucks Rewards account is deregistered or rendered inactive, then all accumulated Stars in your account are void.

9.6        Without notice and by its sole discretion, Starbucks reserves the right to suspend any of your registered Starbucks Card and/or terminate your Starbucks Rewards account and/or your participation into Starbucks Rewards Program if Starbucks determines that you have violated these Terms of Use, or you have more than one (1) Starbucks Rewards account, or that the use of your Starbucks Rewards account is unauthorized, deceptive, fraudulent or otherwise unlawful. Starbucks may, in its sole discretion, suspend, cancel or combine accounts that appear to be duplicative. In the event that your participation into Starbucks Rewards Program is terminated, then all accumulated Stars in your account are void.

  1. Deletion of Starbucks Rewards Account

You may request to delete your Starbucks Rewards account at any time via the account deletion process provided for on the Starbucks Website or Mobile App. Please note that (a) all account deletion requests are final and irreversible once processed; and (b) upon deletion of your account, all information and benefits associated with your deleted account will not be accessible or recoverable, including your account history, Starbucks Card balance, Stars and other reward benefits.

  1. Claims and Disputes

11.1      All claims or disputes arising out of or in relation to these Terms of Use or the Starbucks Rewards Program shall be referred to and finally resolved by National Commercial Arbitration Centre in the Kingdom of Cambodia in accordance with its arbitration rules for the time being in force, which rules are deemed to be incorporated by reference in this Clause. The seat of the arbitration shall be Phnom Penh. The tribunal shall consist of one (1) arbitrator. The language of arbitration shall be English.

11.2      Any award of the tribunal shall be binding from the day it is made, and the parties hereby waive any right to refer any question of law and any right of appeal on the law and/or merits to any court. Judgment on the award rendered by the tribunal may be entered in any court having jurisdiction thereof.
